Contracts
No contract is entered into until PHOTOVENTURES has received the
completed and signed booking form and the payment of the deposit.
Payments
An initial non-returnable deposit of £300 per person is required
together with the signed booking form. The payments will be by instalment
with an initial payment of 50% of the tour cost being required once
a place on the tour is confirmed. The final cost may be paid, in
instalments (as specified by PHOTOVENTURES) or with one the final
payment being made not less than 10 weeks prior to departure. If
a booking is made after that time the payment must be made in full.
If any payment is not made PHOTOVENTURES reserves the right to cancel
your booking and apply a cancellation fee. You will be contacted
prior to this action. Payment is by cheque only. Cheques made payable
to: Photoventures.
Cancellation
by clients
You may cancel your holiday at any time provided that the person
completing and signing the booking form confirms the cancellation
in writing. The following scales will apply to cover administrative
charges and pre-payment made by us:
Less than 90 days 50%
of full tour cost
Less than 65 days 100% of full tour cost
(PHOTOVENTURES will endeavour
to resell any tour to minimise the loss to the individual. However
we cannot guarantee that the tour place will be resold. There is
a charge for this service).
Cancellation
by PHOTOVENTURES
Deposits will be taken to guarantee a place on a tour. In the event
of a minimum number for the tour not being reached necessitating
cancellation or for reasons beyond the control of Photoventures
all payments will be refunded. When the minimum numbers to make
a tour viable is not met and it is necessary for Photoventures to
cancel, clients will be notified as soon as possible but not less
than 42 days prior to departure. If a tour is cancelled due to circumstance
beyond our control or due to unforeseeable circumstances such as
industrial disputes, war or the threat of war, terrorist activity,
civil strife, riots natural or nuclear disaster, fire, flood or
adverse weather conditions PHOTOVENTURES will notify the clients
as soon as reasonably practicable. In such case all clients will
be compensated with the full tour cost less the initial £300
deposit.
Alterations
Whilst every effort is made to adhere to the detailed itinerary
PHOTOVENTURES reserve the right to make any variation to the itinerary
as necessary. All tour members will be notified of any changes.
PHOTOVENTURES retain the right to alter the price of any tour before
entering into a contract with the client.
Surcharges
Surcharges will only be made in the event of a wide fluctuation
in currency exchange rate. The majority of the tour costs are made
in local currency so PHOTOVENTURES is subject to the influences
of the world currency market. In the event of any surcharge tour
members will be notified immediately of the surcharge to be levied.
Photoventures will do all in their power to keep these to the absolute
minimum.
Liability
PHOTOVENTURES undertakes to exercise every care for the safety and
security of its customers. However PHOTOVENTURES cannot be held
liable for events outside its control. PHOTOVENTURES will ensure
that reputable companies provide the services carried out by third
parties, on our behalf. PHOTOVENTURES cannot be held responsible
for their actions or failings how so ever caused. (We cannot guarantee
the weather).
Insurance
We require and it is part of the contract that each customer has
in place suitable comprehensive travel insurance. We can arrange
this for you should you so require. If you arrange this elsewhere
we need to see a copy of the policy to ensure you have suitable
cover at least 8 weeks before the day of departure.
Tour
details
Where hotels or other facts are listed in the tour this is done
in good faith but PHOTOVENTURES retain the right to make any alterations
where and when necessary without consultation. In the event of accommodation
change alternatives of equal standard will be sought.
Normally
included in the price
Transfers when guests travel on the flights specified by PHOTOVENTURES,
ground transport, accommodation on a twin sharing basis and entry
to National & State Parks in the United States. The assistance
of an experienced photographer.
Not
included in the price
Flights (except where specified in the itinerary), single room supplements,
tips, meals (except where specified in the itinerary), telephone
calls, excursion and entry fees not specified in the itinerary,
souvenirs and personal items, excess baggage on all flights, travel
to and from airports of departure in the United Kingdom. Transfers
when using non specified flights.
Flights
PHOTOVENTURES is not party to any flight bookings and receives no
payment whatsoever. Any contract is between the client and the flight
booking agency. Any assistance offered by PHOTOVENTURES is advisory
and clients are able to book any flights they wish. Tours will be
based on an arrival at a given airport/location on a given day.
When PHOTOVENTURES advise client of flight itineraries it will be
coordinated with the itinerary. When clients arrange their own flight
itineraries it will be their responsibility to arrange the transfer
to the hotel/motel unless they arrive at the same time as the main
party.
Travel
delays
PHOTOVENTURES will assist clients with flight itineraries but it
must be clearly understood that it is not party to any flight bookings.
It does not accept liability for any loss or additional expense
caused by delay or interruption to travel services through weather
conditions, civil disturbance, industrial action, strikes, wars,
floods or sickness. Such losses or additional expenses are the responsibility
of the passenger.
Passports
and other Documentation
It is the responsibility of all clients to be in possession of a
valid passport and all visas, or any other necessary documentation
or medical certificates required for the whole of the journey and
the client accepts responsibility for obtaining the same. It is
the responsibility of all clients travelling to the USA to ensure
that they have completed the Electronic System for Travel Authorization
(ESTA). All information and advice given by us on visas, vaccinations,
climate, clothing, baggage, special equipment is done so in good
faith. Clients must furnish PHOTOVENTURES with the full details
of their Passport or other Visa or certificate when required. If
clients fail or refuse to supply such information when requested
they will forfeit 100% of the tour cost. It will be the sole responsibility
of each client to have a valid passport with a minimum of 6 month
left to run, to secure necessary Visas, ESTA or any other required
documents secure and failure to do so resulting in the inability
to travel will be their sole responsibility. In such case PHOTOVENTURES
will have no liability and any such failure will result in the loss
of any money paid up to 100% of the tour cost.
Trust
Account
To comply with the regulations and safeguard the client against
insolvency, all monies, less the non-returnable deposit, are paid
into a Trust Account.
Deposit
A non-returnable deposit of £300 per person is required with
each booking. This will be set against the ground costs. (All deposit
cheques must be made payable to Photoventures).
Insurance
Each person must have insurance to cover them for the duration of
the tour. (You are advised to arrange cover immediately to cover
cancellations etc. A copy of the insurance cover must be forwarded
to PHOTOVENTURES at least 8 weeks before you travel)
Personal
Health
Each person must advise PHOTOVENTURES at the time of booking, of
any personal medical conditions, which may affect him/her during
the tour. This includes details of any medication they may be required
to take during the tour, etc. If any medical condition become evident
after the booking is made and before the date of travel the client
must notify PHOTOVENTURES immediately.
